Welcome to Mud Puppy Enterprises LLC (“Mud Puppy,” “we,” “us,” “our”). These Terms & Conditions (“Terms”) govern quotes, sales, rentals, subscriptions, and services provided by our divisions, including Mud Puppy Outdoor Solutions (fencing, pergolas/patios, outdoor kitchens, landscape & holiday lighting) and Mud Puppy Pooper Scoopers (pet-waste services), plus any related site visits and communications. By approving a quote, placing an order, signing electronically, or using our services, you accept these Terms.

1) Quotes, Scope & Changes

Quote validity. Quotes are valid for 14 days unless stated otherwise and assume normal site conditions.

Scope. Work includes only items listed on the quote/proposal. Exclusions (unless stated): permits/HOA fees, engineering/surveys, remediation of concealed/pre-existing conditions, landscaping unrelated to the scope, pest mitigation, and utility relocations.

Changes. Any change to scope, design, materials, or schedule requires a written change order (we use Jobber). Pricing and timelines may adjust.

Substitutions. We may substitute substantially equivalent materials if the specified item is unavailable, with your approval or where functionally equivalent and non-material to appearance/performance.

2) Scheduling, Site Access & Safety

Scheduling windows are estimates and may shift for weather, safety, or supply constraints.

Access. You will provide safe, clear access to the work area, power and water (as needed), HOA/community approvals, and any gate codes. Please restrain pets and secure valuables.

Site prep. Unless otherwise stated, you are responsible for clearing furniture/decor/landscaping from work areas. Fees may apply if we must perform additional prep/clearing.

Utilities. We request public utility locates before digging (811/Texas811). You must disclose private lines (irrigation, low-voltage, pool, propane, septic, etc.). Damage to unmarked or inaccurately marked private lines is billable.

Hazards. You agree to disclose known hazards (e.g., asbestos/lead paint, contaminated soil, aggressive animals). If work involves pre-1978 painted surfaces, we comply with applicable lead-safe practices when required.

Crew safety. We may suspend or reschedule work for unsafe conditions (including weather, electrical hazards, or aggressive animals).

3) Payments & Invoices

Deposit. 50% deposit is required to schedule.

Balance. Unless otherwise stated in your quote, the balance is due prior to the start of on-site work (or prior to delivery for rentals).

Payment methods. We accept standard forms of payment. Card payments may include a clearly disclosed processing fee where permitted by law and card-network rules. We also offer cash/ACH options without such fees.

Past due. Balances not received when due may accrue 1.5% per month (or the maximum allowed by law) plus collection costs and reasonable attorneys’ fees.

Chargebacks. You agree not to dispute legitimate charges for approved work; chargebacks for completed/authorized work may incur administrative fees.

Tax. Prices exclude applicable sales/use taxes unless stated. Tax-exempt customers must provide a valid certificate before invoicing.

Lien notice. If unpaid, we may suspend work and pursue remedies, including mechanics’ lien rights, as permitted by Texas law.

4) Cancellations, Rescheduling & Refunds
We aim to be fair while protecting against out-of-pocket losses for special-order materials and crew scheduling.

For construction/installation projects (e.g., fencing, pergolas, lighting):

≥10 business days before the scheduled start: Deposit refundable minus any unrecoverable costs (e.g., special-order materials/restocking, design time, permit fees).

3–9 business days before: Refund of deposit minus unrecoverable costs and a 10% scheduling fee (of contract price).

<3 business days before or site not ready at arrival: Deposit refundable minus unrecoverable costs and a 25% short-notice fee (of contract price).
-
Rescheduling once is free with ≥3 business days’ notice; additional reschedules may incur a fee.

For seasonal/holiday-lighting installs:

Materials purchased for you are non-returnable once ordered; cancellation refunds deduct unrecoverable materials and a scheduling fee (10–25% based on timing).

Home-solicitation purchases. If your purchase qualifies as a Texas home-solicitation sale (e.g., concluded at your residence and meeting statutory criteria), you may cancel within three business days by sending a clear cancellation notice to the contact above. We will provide any required statutory notices with your receipt/contract.

5) Warranties & Disclaimers (Installations/Construction)

Workmanship. We warrant our installation workmanship for 12 months from substantial completion, excluding normal wear, maintenance issues, and items in subsection (3). We will repair or re-perform non-conforming workmanship within a reasonable time.

Manufacturer warranties. Products/components are covered by the manufacturer’s warranties (if any). We pass those through and can assist with claims.

Exclusions. No warranty for: normal wood movement/checking/splitting; fading or patina; damage from weather events, flooding, wind, hail, freeze, ground movement, soil heave, pests, pets, vehicles, or third-party actions; misuse or lack of maintenance; power surges; bulbs/consumables.

Information only. Product renderings or examples are illustrative; natural materials vary.

Limitations. To the fullest extent permitted by law, we disclaim implied warranties not required by law and exclude incidental/consequential damages. Nothing in these Terms limits your non-waivable rights under Texas consumer-protection law.

6) Design Ownership & Portfolio Use

Designs & plans we provide (drawings, layouts, lighting designs) remain our intellectual property until paid in full; upon full payment, you receive a non-exclusive license to use them for the project.

Photos/video. We commonly capture before/after photos to document work. We may use project images in our portfolio and marketing unless you opt out in writing before completion.

7) Holiday Lighting Programs
We offer two models; your quote will specify which applies:
(A) Purchase & Install. You own the lights/fixtures after purchase. The quote includes installation and one removal at season end (if stated). Warranty follows Section 5 and product warranties. Future re-installs/removals/storage may be billed.
(B) Seasonal Rental/Subscription. We supply lights as rental property for the season, including installation, in-season maintenance of our equipment, and one removal at season end within our removal window. Lights remain our property and must not be modified by you. Lost/damaged items (beyond ordinary wear) are billable at replacement cost. Service calls due to customer-caused issues (e.g., unplugged timers, tripped breakers) may incur a fee. Weather/wind may require temporary shut-off or adjustments.

8) Equipment Rentals (Non-lighting)

Risk of loss. Responsibility for theft, loss, or damage passes to you upon delivery or pickup and remains until we regain possession.

Use. Operate safely and lawfully, only for intended purposes, and per any provided instructions. No sub-renting or assignment.

Condition. You agree to return equipment clean and in similar condition (normal wear excepted). Cleaning, repair, damage, and missing-parts fees may apply.

Security deposit. If required, we may apply deposits toward amounts you owe. Balances are due upon invoice.

Indemnity. You agree to indemnify/hold harmless Mud Puppy from claims arising out of your misuse or unlawful operation of rental equipment, to the extent permitted by law.

9) Pooper Scoopers Service Terms

Service cadence. Recurring service frequencies (e.g., weekly, bi-weekly) are set in your quote. Initial cleanups or extra-dirty/tall-grass conditions may incur a one-time surcharge, quoted in advance when possible.

Access & pets. Yard must be accessible (unlocked gates, restrained pets). If we cannot access, we’ll attempt to contact you; a missed-visit fee may apply.

Waste handling. Unless otherwise stated, we bag and place waste in your designated bin. Haul-away is available where permitted and may carry a fee.

Weather/holidays. Severe weather or holidays may shift the service day. We’ll reschedule within a reasonable window.

Health & safety. We may refuse service for hazardous conditions (aggressive animals, infestations, biohazards). You represent that your pets are adequately vaccinated per local law.

10) SMS, Email & Electronic Signatures

Texts & emails. By providing contact info, you consent to receive transactional communications about your quotes, appointments, deliveries, or service. Marketing messages require your consent and offer opt-out (unsubscribe/STOP). Consent is not a condition of purchase.

E-sign. You agree that electronic signatures/approvals (including via Jobber, email confirmations, or typed names) are valid and binding as permitted by law.

11) Force Majeure
We are not liable for delays or nonperformance due to causes beyond our reasonable control, including severe weather, flooding, power outages, supply chain failure, labor shortages, epidemics, acts of government, or utility failures. We will resume performance as soon as reasonably practical.

12) Liability Limit
To the maximum extent permitted by law, our total liability for claims arising out of a project/rental is limited to the amounts you actually paid to us for the specific project or rental giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages (lost profits, loss of use), except where such limitation is prohibited by law.

13) Dispute Resolution (Texas); Small-Claims Carve-Out

Good-faith resolution. Most issues can be resolved quickly. Please contact us first.

Mediation/Arbitration. If not resolved within 30 days, disputes (except those within small-claims jurisdiction) will be resolved by binding arbitration in Galveston County, Texas under the AAA Consumer Rules (or another mutually agreed forum). Each party pays its own fees; arbitrator may award fees/costs as allowed by law. Class/representative actions are waived.

Opt-out. You may opt out of arbitration by emailing admin@gomudpuppy.com within 30 days of first accepting these Terms—include your name, service address, and a statement opting out. If you opt out, exclusive venue will be the state courts in Harris County, Texas.

Non-waiver of rights. Nothing here waives your non-waivable rights under Texas law.

14) Governing Law & Severability
Texas law governs these Terms without regard to conflicts rules. If a provision is unenforceable, the remainder stays in effect and the provision is modified to the minimum extent necessary to be enforceable.

15) Updates to These Terms
We may update these Terms to reflect new services or legal changes. We will post the revised Terms with a new “Effective date.” Material changes will be announced via email or a prominent notice on the Site at least 30 days before they take effect, unless a shorter period is required by law.
